Terms of Service

These terms govern your use of Drakata (drakata.app), operated by HeyHo Systems GmbH. By using Drakata, you agree to these terms.
1. Provider

2. The service
Drakata converts text descriptions of sport drills into diagrams using artificial intelligence. Tennis is currently supported; other sports may be offered as previews. The service is provided in the form available from time to time.
3. Your account
Some features require an account, created with your email address (via a sign-in link) or by signing in with Google. You are responsible for activity under your account and for keeping access to your email secure.
4. Free use and future pricing
Drakata is currently provided free of charge, and we intend to keep it free for an extended period while we build our user base. We reserve the right to introduce paid plans in the future.
If we ever introduce paid plans, users who registered before that change will keep free access to the feature scope they had at that time — we will not start charging existing users for what was previously free. We will give reasonable notice before introducing any paid plans.
5. Acceptable use
You agree not to:
- use the service unlawfully, or to create unlawful, infringing, or harmful content;
- attempt to disrupt, overload, or gain unauthorized access to the service or its systems;
- access the service through automated means in a way that places an unreasonable load on it; or
- reverse engineer, copy, or resell the service.
We may limit, suspend, or terminate use that violates these terms.
6. Your content
You keep the rights to the text you submit and the diagrams generated for you. You grant us a worldwide, non-exclusive licence to host, store, process, and display this content as needed to operate the service, to debug and improve diagram generation, and as described in our Privacy Policy. You are responsible for ensuring you have the right to submit your input. We do not share your drills or training content with other users or teams, and we never sell them.
7. AI-generated output
Diagrams are generated automatically by AI and may be incomplete, inaccurate, or misinterpret your description. They are provided for informational purposes — review them before relying on them, including for coaching or training. We give no warranty that output is correct, complete, or fit for a particular purpose.
8. Availability and discontinuation
The service is provided in its available form, without any guarantee of availability. We may change, limit, suspend, or discontinue the service — in whole or in part — at any time, permanently, with or without notice and without giving reasons, and we may delete the data associated with it. We are not liable for any modification, suspension, or discontinuation of the service.
9. Termination of your account
You may stop using the service and delete your account at any time (see the Privacy Policy for how to delete your data). We may suspend or terminate your access if you breach these terms or where required to comply with the law.
10. Liability
As Drakata is provided free of charge, our liability is limited as follows, to the extent permitted by law. We are liable without limitation for damage caused intentionally or by gross negligence, and for injury to life, body, or health. For slight negligence we are liable only for the breach of a material contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible in the first place), and in that case limited to the foreseeable, typical damage. Any mandatory statutory liability, including under the German Product Liability Act, remains unaffected.
11. Changes to these terms
We may update these terms as the service evolves. The current version, with its date, is always available on this page. For material changes we will make reasonable efforts to notify you; continued use after changes take effect constitutes acceptance.
12. Governing law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of your country of residence remain unaffected. If you are a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is our registered seat.
